Indiginis Marketplace — Terms of Service

Intermediary Service: Indiginis provides an online multi-vendor marketplace platform where independent makers, crafters, designers, and artisans (“Sellers”) can list, market, and sell their products to public buyers (“Buyers”).

No Party to Transaction: Indiginis facilitates the platform but is not a party to the actual transaction or contract of sale between Buyers and Sellers.

No Liability for Goods: We do not manufacture, store, or inspect any of the items sold through our platform. We accept no liability for the quality, safety, legality, or delivery of products listed by Sellers.

Eligibility: Users must be 18 years or older and possess legal capacity to enter binding contracts in South Africa.

Account Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

Accuracy of Information: You must provide accurate, current, and complete information during registration and keep it updated.

Authenticity: Sellers warrant that all listed items are original creations, authentic designs, or artisanal goods that do not infringe on any third-party intellectual property or traditional cultural expressions.

Compliance: Sellers must comply with the South African Consumer Protection Act (CPA), specifically regarding accurate pricing, product descriptions, and cooling-off periods.

Orders and Fulfilment: Sellers are independently responsible for packaging, shipping, and ensuring delivery of goods to the Buyer according to their specified timelines.

Transaction Facilitation: Payment processing services on Indiginis are provided by secure third-party payment gateways.

Platform Commission: Indiginis charges a commission fee on transactions processed through the site, as detailed in our Seller Portal. We reserve the right to change these fees upon notice.

Payouts: Seller payouts are processed into verified South African bank accounts following successful delivery or as otherwise outlined in our Seller Payment Schedule.

ECT Act Compliance: In accordance with the Electronic Communications and Transactions (ECT) Act, Buyers have a general 7-day cooling-off period to cancel certain transactions without penalty, except for custom-made or personalized artisanal goods.

Defective Goods: If a product is defective or does not match the description, the Buyer must log a dispute through Indiginis. Sellers are legally bound by the CPA to offer a repair, replacement, or refund for defective items.

Dispute Resolution: While Indiginis may assist in mediating disputes between Buyers and Sellers to preserve marketplace integrity, our decision is not a legal ruling, and we are not liable for the financial outcome.

Platform Content: All text, graphics, logos, and software code on www.indiginis.co.za are the property of Indiginis or its licensors and are protected by South African copyright laws.

Seller Content: Sellers retain copyright over their product images, descriptions, and brand names. However, by listing on Indiginis, Sellers grant the platform a non-exclusive, worldwide, royalty-free license to use, display, and promote their listings for marketing purposes.

“As-Is” Platform: The platform is provided on an “as-is” and “as-available” basis without any warranties of any kind.

Indemnity: Users agree to indemnify and hold harmless Indiginis, its directors, and employees from any claims, damages, or legal costs arising out of your breach of these terms, your use of the platform, or your violation of any laws.

POPIA Compliance: Your personal data is handled strictly in accordance with the Protection of Personal Information Act (POPIA). Please refer to our separate Privacy Policy to understand how we collect, store, and process your information.

South African Jurisdiction: These terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms will be subject to the exclusive jurisdiction of South African courts.
